User Agreement

This "User Agreement" (hereinafter referred to as "this Agreement") is a set of rights and obligations established between you (hereinafter referred to as the "User") and the internet services provided by HautHome (hereinafter referred to as HautHome). These terms of service are legally binding for both the User and HautHome. This Agreement, together with all updates, supplementary terms, and other rules and policies of HautHome, constitutes the agreement between the User and HautHome.

HautHome hereby specially reminds users that before registering for and using HautHome services, please carefully read all terms of this agreement and fully understand the content of each clause before clicking "Agree." This is particularly important for clauses that exempt or limit HautHome's liability, clauses that restrict user rights, and clauses regarding applicable law and dispute resolution. These clauses will be highlighted as much as possible in bold and underlined. If a user completes the registration process by filling in the required information as prompted on the registration page and clicking "Agree" to this agreement, or continues to use the services provided by HautHome after this agreement is updated, it indicates that the user has fully read, understood, and accepted all the contents of this agreement, thereby becoming a party to this legally binding agreement. If the user disagrees with any clause of this agreement and/or the modified content, they should immediately stop the registration process or cease using the services provided by HautHome.

I. Account Registration and Use

1. When using the full services of HautHome, users may need to register an account. Upon successful registration, an HautHome account will be created, along with corresponding account information such as a username and password. The ownership of the HautHome account belongs to HautHome. After completing the registration process, users obtain the right to use the HautHome account. This right is exclusively granted to the initial registrant and is strictly prohibited from being gifted, borrowed, leased, transferred, or sold. Users are advised to store and use their username and password with caution and responsibility.

2. When registering for and using HautHome services, users must provide HautHome with truthful, accurate, complete, legally valid information, and are obligated to maintain and promptly update such information. Users must ensure that their registration information, including account name, profile picture, and bio, does not contain any illegal or inappropriate content. If the information provided by the user violates these requirements, the user shall bear the corresponding responsibilities and consequences arising therefrom, and HautHome reserves the right to terminate the user's access to any HautHome services or take other appropriate measures.

3. As the provider of HautHome services, in order to enable users to better utilize the various services of HautHome and ensure the security of user accounts, HautHome has the right to require users to complete real-name authentication in accordance with the laws and regulations of our country.

4. Users shall bear legal responsibility for all activities and events conducted under their user accounts. Users agree not to use other users' accounts or passwords under any circumstances, impersonate others, or maliciously use registered accounts to cause other users to be misled. Otherwise, HautHome reserves the right to immediately suspend services, revoke the account, and hold the user solely liable for all resulting legal consequences. If a user suspects that someone else is using their account or password, the user agrees to immediately notify HautHome and provide relevant identification documents and other materials as required by HautHome. The user also agrees to authorize HautHome to take all reasonable measures to protect the user's interests from harm and acknowledges that the legal effects of such measures shall be attributed to the user. HautHome shall not be held liable for any unauthorized use of accounts or passwords due to reasons beyond HautHome's control, such as hacking or user negligence in safeguarding their account information.

5. Any direct or indirect use of HautHome services and data by users, through various means (such as RSS feeds and external API references, etc.), will be deemed as unconditional acceptance of all the terms of this agreement. If users have any objections to any clause of this agreement, please cease using all services provided by HautHome.

II. Service Content and User Conduct Guidelines

1. The specific content of services provided by HautHome is determined by HautHome based on actual circumstances. HautHome reserves the right to change, interrupt, or terminate part or all of the services at any time, and HautHome shall not be liable for any losses incurred by users due to business adjustments. Unless otherwise expressly stipulated in this agreement, any adjustments, additions, or enhancements to any features within HautHome services, including newly launched products, are subject to the terms of this agreement.

2. HautHome is a platform for information sharing, dissemination, and acquisition. Information published by users on HautHome is considered public, and other third parties may access it through HautHome. By publishing any information, users acknowledge that such information is public, and any information they do not wish to be known by other third parties should not be published on HautHome. If, according to relevant laws and regulations, other third parties require additional user consent to access the information published by users, such matters shall be resolved through negotiation between the third party and the user. The actions of third parties are unrelated to HautHome, and any cooperation between users and third parties must not violate the terms of this agreement.

3. Users undertake not to use HautHome in any way to engage in activities that violate Chinese laws and social morality, either directly or indirectly. HautHome reserves the right to delete any content that breaches the above commitments. Any content transmitted or published by users while using HautHome services solely reflects their personal views and positions, and does not reflect or represent, nor should it be considered as reflecting or representing, the views, positions, or policies of HautHome. As the publisher of the content, users are solely responsible for the content they publish and bear all legal liabilities. HautHome does not guarantee the accuracy or completeness of the content transmitted or published by users. Except as required by laws and regulations, HautHome assumes no other responsibilities.

4. Users shall not upload, copy, publish, disseminate, or repost the following content while using HautHome services:

(1) Opposing the fundamental principles established by the Constitution;
(2) Endangering national security, leaking state secrets, subverting state power, or undermining national unity;
(3) Harming national honor and interests;
(4) Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;
(5) Undermining national religious policies, promoting cults, or spreading feudal superstitions;
(6) Spreading rumors, disrupting social order, or undermining social stability;
(7) Disseminating obscenity, pornography, gambling, violence, murder, terrorism, or inciting criminal activities;
(8) Insulting or defaming others, infringing upon the lawful rights and interests of others;
(9) Containing other information prohibited by laws and administrative regulations.

5. Users should read and fully understand in advance that using HautHome's various services requires compliance with the following relevant rules:

(1) Principles of Service Use

The user agrees that the use of any services provided by HautHome shall comply with the principles of service usage, meaning that HautHome administrators have the right to take measures, including but not limited to warnings, deadlines for correction, muting, and banning, against users who violate the community guidelines.

(2) Submission Guidelines

To better develop the HautHome user content ecosystem, users acknowledge and agree that articles submitted to HautHome must comply with the corresponding formats and rules. If users fail to adhere to these rules, HautHome reserves the right to reject the publication of related original articles. In cases involving violations of laws and regulations or infringement of the legitimate rights and interests of others, users shall bear the risks of failing the review process, and HautHome has the right to take appropriate actions in accordance with the law and service usage principles. Should any disputes, claims, or penalties arise as a result, users are responsible for resolving them independently, and HautHome assumes no liability in this regard.

(3) Rules related to user activity participation

Users participating in specific user activities organized by HautHome must comply with the user activity guidelines and other relevant rules corresponding to the specific activity. If users violate the relevant rules, HautHome reserves the right to disqualify them from receiving prizes. In the event of force majeure, HautHome retains the right to cancel the ongoing activity.

(4) Other relevant rules that HautHome may issue, modify, or improve from time to time.

The above rules constitute an important part of this agreement. In the event of any conflict between the specific rules and this agreement, or if this agreement does not explicitly address certain matters, the content of the respective rules shall prevail.

III. Intellectual Property Rights

1. The intellectual property rights of content published by users on HautHome (including but not limited to original articles and comments) belong to the users themselves or other legitimate intellectual property rights holders.

2. The user undertakes that all content published by them on HautHome (including but not limited to: text, images, or audiovisual materials) is either original to the user or has obtained prior written permission from the relevant rights holders, and is free from any defects or encumbrances. If a third party raises objections regarding intellectual property rights, HautHome reserves the right to take appropriate measures, such as deletion, blocking, or disconnecting links to the relevant content, in accordance with applicable laws and regulations and based on the actual circumstances. HautHome also reserves the right to pursue legal action against the user. Should any losses be incurred by HautHome or any third party as a result, the user shall be responsible for compensation.

3. The user agrees to grant HautHome a free, irrevocable, non-exclusive, and sublicensable license worldwide for all content published on HautHome (including content already published and content that may be published in the future). This license allows HautHome to use, copy, modify, adapt, publish, translate, create derivative works based on, distribute, perform, and display such content (in whole or in part), and/or incorporate such content into any other forms of works, publications, journals, reports, or technologies currently known or developed in the future. Additionally, HautHome has the right to use or authorize the use of the aforementioned content on third-party websites cooperating with HautHome. When HautHome uses the user's published content in accordance with this provision, it does not require prior consent from the user. Furthermore, the user agrees that, apart from rewards such as coins that may be explicitly provided to the user on the HautHome platform, HautHome will not pay any additional fees or provide any other material rewards to the user for publishing content.

4. The user agrees that HautHome has the right, when using content published by the user, to modify the article title and edit or revise the wording of parts of the content as necessary, without altering the overall meaning of the original text, unless otherwise specified by other rules. HautHome ensures that any editing or modification will not intentionally distort or misrepresent the user's original intent, nor deliberately use any content that may lead to infringement. Content modified under this provision still represents the user's viewpoint, and HautHome assumes no legal or financial liability for any disputes that may arise from the modified articles or content. If the user finds that HautHome's edited or modified content contradicts their original intent or may lead to any infringement disputes, the user may promptly notify HautHome in an effective manner, and HautHome will take appropriate measures to address the issue.

5. The commercial logos, layout designs, typography, text, images, graphics, audio, video, relevant data, and other content and resources used in the services provided by HautHome, including their copyrights, trademarks, patents, trade secrets, and other intellectual property rights, are owned by HautHome or designated third parties by HautHome. They are protected by laws, regulations, and relevant international treaties, except for the rights that relevant rights holders are entitled to under the law.

6. Unless otherwise stipulated by laws and regulations, without the permission of HautHome or relevant rights holders, no unit or individual may illegally copy, reprint, quote, link, crawl, reverse engineer, reverse compile, disassemble, or otherwise use any information content, including text, images, graphics, audio, and/or video materials, contained in the services provided by HautHome, in whole or in part, in any form. Otherwise, HautHome or relevant rights holders have the right to pursue legal liability. HautHome shall not be responsible to users or any third party for any delays, inaccuracies, errors, omissions, or any damages arising from or in connection with the transmission or delivery of all or part of the aforementioned materials.

IV. Reporting and Complaints Regarding Infringement

1. HautHome respects the intellectual property rights of every user and hopes that users will comply with China's legal regulations regarding intellectual property when using this service. Users understand and agree that all content they publicly post on HautHome should be original, with complete and flawless intellectual property rights, or they must have obtained prior written permission from the relevant rights holders. If the content posted by users on HautHome infringes upon the copyrights or other rights of third parties, HautHome has the right to handle the matter in accordance with legal provisions.

2. If HautHome discovers or receives reports or complaints from others that a user has violated the terms of this agreement, HautHome has the right to review the allegedly infringing content and user information without notifying the user suspected of infringement. HautHome has the right to take appropriate measures, such as deletion, blocking, or disconnection of links, in accordance with the actual circumstances and legal provisions, and may impose corresponding penalties on the offending account.

3. If a rights holder or their legal representative discovers content on HautHome that infringes upon their legitimate rights and interests, they may first attempt to contact the author to resolve the issue through communication and negotiation. If the rights holder or their legal representative is unable to contact the author or cannot resolve the issue through communication with the author, they may file a complaint with HautHome. To ensure timely and effective handling of the issue, please be sure to submit authentic, valid, complete, and clear materials; otherwise, the complaint may not be accepted. The materials that the complainant needs to provide to HautHome include:

(1) The right holder possesses proof of ownership for the allegedly infringing content, including trademark rights, copyrights, and/or other legally exercisable rights. Proof of ownership includes but is not limited to business licenses, trademark registration certificates, copyright registration certificates, etc.;
(2) The right holder's identity proof, which may be an ID card or passport;
(3) If the complainant is the lawful agent of the right holder, in addition to the above materials, the complainant must also provide written authorization to represent the right holder in filing the complaint, along with the right holder's identity proof;
(4) To ensure the authenticity of the complaint materials, in cases of infringement complaints, the right holder must also sign the following legal declaration:

a. I am the legitimate rights holder of the content being complained about;

b. I am complaining that the content posted on the HautHome platform infringes upon my corresponding legitimate rights and interests

c. If the content of this infringement complaint is not entirely accurate, I will bear all legal responsibilities arising therefrom and compensate HautHome for any losses incurred due to the handling of the relevant account based on the complainant's notice, including but not limited to losses suffered by HautHome as a result of compensating the complained party, as well as damages to HautHome's reputation and goodwill.

4. HautHome reserves the right to review and supervise users' use of the services. If any user violates the provisions of this agreement while using the services, HautHome has the right to require the user to make corrections or directly take all necessary measures (including but not limited to modifying or deleting content posted by the user, suspending or terminating the user's right to use the services, etc.) to eliminate or mitigate the impact caused by the user's improper conduct. At the same time, as a network service provider, HautHome does not have sufficient monitoring capabilities to prevent illegal reprinting, false publication, or piracy. HautHome shall not bear legal liability for such infringements committed by others on the website, and the liability for infringement shall be borne solely by the party committing the act.

5. If any third party infringes upon the relevant rights of HautHome users, the user agrees to authorize HautHome or its designated agent to, on behalf of HautHome itself or the user, issue warnings, file complaints, initiate administrative enforcement actions, lawsuits, appeals, or negotiate settlements with such third party. The user also agrees to participate in joint rights protection efforts or sign and issue relevant materials such as authorization documents when HautHome deems it necessary.

V. Protection of User Personal Information

1. The user agrees that HautHome will collect, use, store, share, and protect the user's personal information in accordance with relevant laws and regulations, this agreement, and other rules established by HautHome regarding personal information protection. In the event of any conflict between the provisions of this agreement concerning personal information protection and other rules established by HautHome regarding personal information protection, or if this agreement does not explicitly address matters related to personal information protection, the content of the other rules regarding personal information protection shall prevail.

2. Protecting users' personal information is a fundamental policy of HautHome. HautHome guarantees not to disclose or provide users' registration information and non-public content stored on HautHome while using its services to third parties, except as otherwise required by laws and regulations or as otherwise agreed in other rules established by HautHome regarding personal information protection.

3. When required by the court, government authorities, or when HautHome needs to protect its own or a third party's legitimate interests, the user agrees that HautHome has the right to use the user's registration information, username, password, and other details to log into the user's registered account for evidence preservation, including but not limited to notarization and witnessing.

VI. Agreement Modification

1. In accordance with the development of the internet and changes in relevant laws, regulations, and normative documents, or due to business development needs, HautHome may modify or update the terms of service of this agreement as necessary. HautHome will directly publish the revised agreement content on the HautHome website. Such publication shall be deemed as HautHome having notified users of the modifications. Once published, the revised content will effectively replace the original terms of service. HautHome may also use email or private messaging to notify users of changes to the agreement terms, service updates, or other important matters.

2. Additionally, users can log in to the HautHome website to review the latest version of the relevant agreement terms. If users continue to use the services provided by HautHome, it will be deemed that they have accepted the modified service terms; if users do not accept the modified service terms, they should cease using the services provided by HautHome.

VII. Disclaimer

1. HautHome will reasonably review the information on products, services, advertisements, and other content on the HautHome website in accordance with legal and regulatory requirements. However, HautHome cannot guarantee the accuracy and completeness of external links provided and assumes no responsibility for the content of any webpages linked through such external links that are not under HautHome's actual control. Additionally, the services provided by HautHome may involve content offered by third-party individuals or entities. The quality and content of such third-party services are the sole responsibility of the third parties. Users should be aware of and comply with the third-party service agreements when using third-party services. Users must independently evaluate and assume all risks associated with third-party content, products, services, advertisements, and any other information. HautHome does not guarantee the timeliness, security, or accuracy of such content or network services. HautHome shall not be held liable for any disputes or damages arising therefrom.

2. HautHome does not guarantee that the service will meet the user's requirements. HautHome shall not be held liable for service interruptions or other defects caused by force majeure or reasons beyond HautHome's control. However, HautHome will take reasonably prudent measures to minimize the losses and impacts caused to users as a result.

3. The user understands that HautHome may need to periodically or occasionally inspect, maintain, or upgrade the platforms providing network services (such as internet websites, mobile networks, etc.) or related equipment. If such activities cause interruptions to network services within a reasonable timeframe, HautHome shall not be held liable for any responsibility. However, HautHome will make every effort to provide prior notice whenever possible.

4. The user understands and acknowledges that during the use of this service, there may be information from any other person, including misleading, deceptive, threatening, defamatory, offensive, or illegal information, as well as anonymous or impersonated information that infringes upon the rights of others, along with actions accompanying such information. In this regard, the user is advised to exercise caution in judgment and not to trust such information to the extent of incurring losses. HautHome will provide necessary assistance to the user for any losses caused to the user or any third party as a result, but shall not bear any liability.

5. Under no circumstances shall HautHome be liable for any indirect, consequential, punitive, incidental, special, or penal damages, including but not limited to loss of profits suffered by users due to the use of HautHome services, even if HautHome has been advised of the possibility of such damages.

VIII. Other Matters

1. The validity, interpretation, and resolution of disputes under this agreement shall be governed by the laws of the People's Republic of China. In the event of any dispute or controversy between the user and HautHome, the parties shall first attempt to resolve it through friendly negotiation. If negotiation fails, the user agrees to submit the dispute or controversy to the competent people's court located at HautHome's place of jurisdiction.

2. If any provision of this agreement is invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect and be binding upon both parties.
